Hugo Despres and Phédâvrïl Racine‑St‑Jean against Air Canada Subsection 27(1) of the Canada Transportation Act, S.C., 1996, c. 10, as amended (CTA) and paragraph 113.1(a) of the Air Transportation Regulations, SOR/88-58, as amended (ATR).

 

Application regarding Air Canada’s failure to comply with its obligation to provide passengers of Flight No. AC797 with the option to disembark due to a tarmac delay for a flight from Montréal, Quebec, to Los Angeles, United States, on January 13, 2018.

 

Applicants sought to require Air Canada to update its procedures and the training provided to its flight crew.  In addition, to remit the matter to an enforcement officer for consideration of a notice of violation under section 180 of the CTA.

 

Application dismissed for reasons the Agency finds that Air Canada properly applied the terms and conditions set out in Rule 80 of its Tariff.
