SELECTED EXPERIENCE

  • successful defence of public accountants in cases based on alleged negligence in the conduct of assurance engagements;

  • representation of air carriers in the course of accident investigations, inquiries and civil court proceedings following aviation disasters (Air Canada following the Cincinnati fire of June 2, 1983, Air India following the loss of “Kanishka” on June 23, 1985; Air Ontario following the Dryden accident of March 10, 1989; Nationair following the loss of flight 2120 at Jeddah on July 11, 1991; Air Canada following the accident at Fredericton on December 16, 1997);

  • work with management of a firm of public accountants on development of internal policies and procedures, including policies relating to the identification and addressing of conflicts of interest;

  • obtaining of operating authority, economic licences and waiver of regulatory requirements for numerous international air carriers;

  • negotiation and approval of code sharing agreements and wet leases;

  • representation of air carriers before the Canadian Transportation Agency, Human Rights Tribunal and Federal Court of Appeal in high profile cases involving emerging issues (right to carry kirpans on aircraft, discrimination based on “profiling”, obesity as a disability, provision of medical oxygen services in flight, accommodation of persons with allergies);

  • providing of advice on the development and implementation of privacy policies;

  • providing advice on the requirements of Canadian transportation legislation and the implications of those requirements for the consummation of proposed acquisitions of transportation undertakings;

  • representation of carriers in prosecutions relating to the carriage of dangerous goods;

  • representation of clients in international commercial arbitration.
