Employment Law

Bersenas Jacobsen Chouest Thomson Blackburn LLP’s employment practice group has gained a reputation for providing employers with timely, pragmatic and cost effective services in the area of employment law.

We act for a variety of employers including major hotels, air carriers, educational institutions, and financial institutions.

Employment law is concerned with the legal relationship between employers and employees. Employment litigation may involve disputes about the dismissal of employees, discrimination and human rights claims, claims of workplace injuries and harassment, statutory employment standards, health and safety standards, and the enforcement of non-solicitation and non-compete clauses.

Our lawyers regularly counsel employers on the following:

Employment Contracts

We advise our clients on, or assist with the preparation of, agreements dealing with all aspects of the employment relationship including termination clauses, bonuses, long term incentive plans and restrictive covenants. With the benefit of our wrongful dismissal litigation experience our lawyers know the benefit of clear and concise contract language.

Wrongful Dismissal Litigation

We act for employers in wrongful termination suits, and will vigorously defend management’s right to end the employment relationship. Our lawyers have appeared before all levels of court and tribunals on motions, trials, and appeals.

Human Rights

We provide advice to employers to minimize their exposure to human rights violation complaints, and when necessary defend our clients before human rights tribunals.

Employment Standards

Our lawyers advise clients regarding their obligations under the Employment Standards Act, 2000 and will represent employers before Ministry of Labour Officers and at the Ontario Labour Relations Board on issues relating to employment standards.

Workplace Investigations

Our lawyers are experienced in conducting workplace investigations into workplace harassment and discrimination, human rights, and health & safety issues.

Management Training

Because of our experience we are able to provide practical training to employers on a number of employment law issues including workplace policies and procedures, progressive discipline, hiring practices, termination, and workplace discrimination and harassment.
